Terms & Conditions
DEFINITIONS

Activity/Activities means any of Alexander Kay's Activities within 'Mountaineering', 'Paddlesport', 'Event' and/or 'NGB' on offer on This Website from time to time;
Booking/Bookings means a booking made by You for any of Alexander Kay's Expeditions, Activities or Courses;
Commencement Date means the first date in which any of Alexander Kay's Expeditions, Activities or Courses commence;
Course/Courses means any of Alexander Kay's Courses within 'Mountaineering', 'Paddlesport', 'Event' and/or 'NGB' on offer on This Website from time to time;
Expedition/Expeditions means any of Alexander Kay's Expeditions within 'Expedition', on offer on This Website from time to time;
External Website/s means any External Website/s not owned or managed by Alexander Kay
Participating Adult means an adult who actively participates in any of Alexander Kay's Expeditions, Activities or Courses;
Staff means any person working for Alexander Kay;
Terms & Conditions means these Terms & Conditions outlined here;
Terms of Use means the Terms of Use of This Website outlined within these Terms & Conditions;

You/Your/Yourself/Customer/Individual/Individuals/They means the person/s for whom Alexander Kay has agreed to provide the Expedition, Activity or Course, and/or the user or viewer of This Website;
BOOKING
To make a Booking, You must complete a Booking form.
For private group Bookings, a single, initial Booking form can be completed by the Individual making the Booking, however, all Participating Adults must complete a Booking form prior to the Commencement Date of the Expedition, Activity or Course They are booked onto. Only on receipt of a completed Booking form and deposit or full payment (if not already paid for by the initial Individual making the Booking), will Your place be guaranteed.
If any medical problems arise, between signing and submitting Your own Booking form and the Commencement Date of the Expedition, Activity or Course You are booked onto, You must notify Alexander Kay immediately.
Alexander Kay takes no responsibility if You send Your Booking form to the incorrect email address. Guidance on how and where to send Your Booking form can be found on the How To Book page.
PARTICIPATION
Alexander Kay may require You to obtain confirmation from a medical professional that You are fit to travel and participate in any of the Expeditions, Activities or Courses.
You are required at all times to follow all safety instructions given to You on any of the Expeditions, Activities or Courses as well as during an emergency situation, should it arise.
Alexander Kay can and does work with under 18's but for this to take place the parent or guardian must accompany the minor on all Expeditions, Activities or Courses.
Weather and conditions can require an adjustment to the program for safety considerations. Any adjustments will be communicated and agreed with You. An alternative is always available.
If at any time you are uncomfortable or wish to stop please inform Alexander Kay. A discussion with You will then take place, highlighting the options should You wish to cease partaking in the Expedition, Activity or Course.
Should You, or any other Participating Adult (if partaking as a group), wish to withdraw from any of the Expeditions, Activities or Courses, then it may require all members of the group to return to a safe road side location if Alexander Kay deems conditions are serious enough. No refund will be given to any member of the group in this instance.
If You insist on removing Yourself from any of the Expeditions, Activities or Courses, against Alexander Kay's advice then Alexander Kay will no longer hold a professional duty of care, or be held accountable for Your actions and any outcome resulting from them.
Alexander Kay, whenever appropriate, will allow for a participation-related issue to be resolved by another member of Staff.
Alexander Kay reserves the right to refuse to allow You to continue to participate in any of the Expeditions, Activities or Courses for any of the following reasons, including, but not limited to:
> You have not completed a Booking form prior to the Commencement Date, for example in the case of private group Bookings
> A previously undisclosed medical or health condition related to You is brought to Alexander Kay's attention, which deems the Expedition, Activity or Course unsafe for the participation of Yourself or any other Individuals involved.
> You are unable to continue due to fitness-related issues, deeming Your participation unsafe for You or any other Individuals involved.
> Your have not brought suitable personal equipment, deeming Your participation unsafe for You or any other Individuals involved.
> You have not met the pre-requirements of the Course, in the case of Courses governed by Mountain Training.
INSURANCE
Alexander Kay's Expeditions, Activities and Courses do not include any personal accident, cancellation, third party liability or personal insurance. Alexander Kay recommends that You take out Your own policy, even if You are Booking as a member of a group, and will accept no responsibility whatsoever in respect of loss or damage to Your personal property.
In the case of a suspected or confirmed emergency involving You or the group of which you are a member, Alexander Kay reserves the right to arrange (or to make arrangements for its or Your insurers to arrange) search, rescue and recovery as deemed appropriate and reasonable. You agree to indemnify Alexander Kay and keep Alexander Kay indemnified from all losses, apportioned appropriately to You, arising from any such search, any such helicopter usage, and any resulting repatriation, for medical or non-medical reasons, including legal costs of making a recovery against You.
PAYMENTS
All payment details below refer to You, the Customer, unless otherwise specified:
Payments can be made in full or in instalments, subject to the time of Booking.
A payment of a deposit or full fee, along with a completed Booking form, is required to secure a Booking.
All deposits are non-refundable and non-transferable, following a 7-day cooling off period.
All deposits are 20% of the full fee and shall be paid at the time of Booking.
Payment of a further 40% of the original full fee shall be paid a minimum of 12 weeks prior to the Commencement Date.
Payment of the final balance of the original full fee shall be paid a minimum of 6 weeks prior to the Commencement Date. If any outstanding balance is not paid by 6 weeks prior to the Commencement Date, then Alexander Kay reserves the right to cancel Your Booking and re-sell Your space, without refunding Your deposit.
Where a Booking is made last minute (within 6 weeks of the Expedition's, Activity's or Course's Commencement Date), then the full fee is required at the time of Booking.
Fees include all guiding/instruction/coaching and stated specialist equipment. Additional costs you will be required to cover include, but are not limited to, entry into climbing walls (unless stated otherwise), uplift on gondala or chair lifts and hire of specialist winter equipment, such as ice axes, crampons and winter boots.
REFUNDS AND CANCELLATIONS BY YOU
All refund and cancellation details below refer to You, the Customer, unless otherwise specified:
Following payment of the deposit and subsequent 7-day cooling off period, the deposit will be fully non-refundable and non-transferable in all circumstances.
For Expeditions, the full balance of the fee (less deposit) is only refundable if cancellation or withdrawal is made more than 24 weeks before the Commencement Date; For Expeditions, no refund of the Expedition cost will be given if cancellation or withdrawal is made between 24 weeks before the Commencement Date and the Commencement Date itself, or if made at any time after the Commencement Date.
For all other Activities and Courses, the full balance of the fee (less deposit) is only refundable if cancellation or withdrawal is made more than 6 weeks before the Commencement Date; For Activities and Courses, no refund of the Activity cost and/or Course cost will be given if cancellation or withdrawal is made between 6 weeks before the Commencement Date and the Commencement Date itself, or if made at any time after the Commencement Date.
The Expedition cost, Activity cost and Course cost is stated on each of the Expedition's, Activity's and Course's relevant page on This Website.
REFUNDS AND CANCELLATIONS BY ALEXANDER KAY
In the unlikely event that Alexander Kay has to cancel an Expedition, You will be entitled to a full refund, including Your deposit. Alexander Kay reserves the right to cancel any of the Expeditions for, but not limited to, any of the following reasons:
> It does not meet minimum group numbers
> Where circumstances beyond Alexander Kay's reasonable control arise, for example: global pandemic, war, civil or political unrest, terrorism, extreme weather conditions or technical problems with transport.
Alexander Kay cannot offer any refunds for any insurance premiums You may have taken out with any third parties in relation to Your Booking, and Alexander Kay recommends that You utilise your insurance cover before requesting or accepting a refund. Alexander Kay strongly advises that You take out adequate travel insurance as soon as You have made Your Booking. This should be in line with the Terms & Conditions outlined here and contain cancellation cover.
In the unlikely event that Alexander Kay has to cancel an Activity or Course, You will be entitled to a full refund, including Your deposit, or You be will offered an alternative date. Alexander Kay reserves the right to cancel any Activity or Course for any of the following reasons, including, but not limited to:
> It does not meet minimum group numbers
> Where circumstances beyond Alexander Kay's reasonable control arise, for example: global pandemic, war, civil or political unrest, terrorism, extreme weather conditions or technical problems with transport.
Alexander Kay will not be liable for any travel or accommodation-related expenses that are incurred by You in any circumstance.
